1. Acceptance of Terms

Welcome to SeaVela. By using the SeaVela website (seavela.wtlapp.com), mobile app, or any connected services (together called the "Platform"), you agree to follow these Terms of Service ("Terms") and our Privacy Policy. If you don’t agree with these Terms, you shouldn’t use our Platform.

These Terms are a legal agreement between you ("User," "you," or "your") and SeaVela ("Company," "we," "us," or "our").

We can change these Terms anytime. If you keep using the Platform after the changes are posted, it means you accept the updated Terms.

2. About SeaVela

SeaVela is a high-quality marketplace where you can rent boats and yachts from different providers in Portugal. Our platform connects travelers, who are looking to rent boats ("Renters"), with boat owners and charter companies ("Operators"). We offer a wide range of vessels such as yachts, motor boats, sailboats, catamarans, RIBs, jet skis, canal boats, gulets, luxury yachts, and houseboats along Portugal's coast, including popular areas like the Algarve, Madeira, Vilamoura, and Carcavelos.

SeaVela is not a boat operator, charter company, or transportation service on its own.

Instead, we act as a middleman, and the actual boat rental services are provided directly by the Operators listed on our platform.

3. Eligibility

To use our Platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Platform under applicable laws
  • Provide accurate, truthful, and complete information during registration and booking

By using the Platform, you represent and warrant that you meet all eligibility requirements listed above. SeaVela reserves the right to suspend or terminate accounts that do not comply with these requirements.

4. User Accounts

4.1 Account Registration

To use some of the Platform's features, you need to create an account. You promise to give true and up-to-date information and to make sure your account details are always current. You are in charge of keeping your account login details safe and for any actions that happen while using your account.

4.2 Account Security

If you think someone is using your account without permission, you need to let SeaVela know right away at info@seavela.com. SeaVela isn’t responsible for any losses or problems that happen because you didn’t keep your account information safe.

4.3 Account Termination

SeaVela can stop or permanently end your account at any time if you break these Terms, do anything dishonest, or put others or operators at risk.

5. Booking and Payments

5.1 Booking Requests

When you send a booking request using our platform, you are asking to rent a boat from an independent operator. Your booking isn't considered confirmed until you get a written confirmation from SeaVela or the operator. SeaVela can choose to say no to any booking request if they decide to.

5.2 Pricing

All prices shown on the Platform are in Euros (EUR) unless mentioned otherwise. The prices are determined by each Operator and can change depending on the vessel, time of year, length of stay, and location. SeaVela isn't responsible for any pricing mistakes made by Operators, but we will do our best to let you know if there are any issues.

5.3 Payment

Your payment is processed securely via our third-party payment providers. When you make a booking, you are allowing SeaVela or the Operator to charge the correct amount to your chosen payment method. You agree to pay all related fees, including any taxes and service charges that may apply.

5.4 Cancellations and Refunds

Cancellation and refund rules can be different for each Operator and boat. The specific policy that applies will be shown when you book. SeaVela isn't responsible for any refunds beyond what the Operator's policy allows. If a cancellation happens because of bad weather or unexpected events beyond control, the Operator might choose to offer a new date or a partial refund.

6. Operator Responsibilities

Operators listing vessels on SeaVela agree to:

  • Ensure all vessels are fully certified, maintained, and compliant with Portuguese and EU maritime regulations
  • Employ licensed and experienced captains and crew where required
  • Provide accurate descriptions, photos, and availability information for their listings
  • Maintain valid insurance coverage for their vessels and passengers
  • Honour confirmed bookings and provide the agreed-upon service
  • Comply with all applicable maritime safety standards and local regulations

SeaVela reserves the right to remove any Operator listing that does not meet our verification and quality standards.

7. Renter Responsibilities

As a Renter, you agree to:

  • Provide accurate information when making a booking, including passenger count and travel dates
  • Follow all safety instructions provided by the Operator and crew
  • Treat the vessel, crew, and other passengers with respect
  • Not use the vessel for any illegal activity
  • Not operate the vessel unless explicitly permitted and properly licensed to do so
  • Return the vessel in the same condition as received, subject to normal use
  • Comply with all applicable maritime regulations and the Operator's rules

You are responsible for the behaviour of all passengers in your booking. SeaVela and Operators reserve the right to refuse service or end a charter early if passengers behave in an unsafe, disruptive, or illegal manner without entitlement to a refund.

8. Safety and Maritime Compliance

Your safety is our highest priority. All vessels listed on SeaVela must hold valid safety certifications and meet official maritime standards. We strongly encourage all Renters to:

  • Listen carefully to all safety briefings before departure
  • Wear life jackets when required or recommended by the crew
  • Disclose any medical conditions relevant to sea travel at the time of booking
  • Not board a vessel under the influence of alcohol or controlled substances

SeaVela does not assume responsibility for accidents or injuries arising from a failure to follow safety instructions, or from actions contrary to the crew's guidance or applicable maritime law.

9. Prohibited Conduct

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent content or listings
  • Circumvent or bypass SeaVela's booking process to conduct transactions off-platform
  • Harass, threaten, or discriminate against other users or Operators
  • Upload malicious code, spam, or content that infringes third-party intellectual property
  • Scrape, copy, or systematically extract data from the Platform
  • Impersonate another person or entity
  • Use the Platform for any unlawful purpose

Violation of these prohibitions may result in immediate account suspension, termination, and reporting to relevant authorities.

10. Intellectual Property

All the content on the SeaVela Platform, like logos, text, images, graphics, software, and design, belongs to SeaVela or their licensees and is protected by intellectual property laws. You are allowed to access and use the Platform for personal, non-commercial reasons only. You can't copy, share, change, or make new works based on any content from the Platform without our written permission first.

11. User-Generated Content

When you share reviews, photos, messages, or any other content on the Platform, you allow SeaVela to use, show, and share that content globally without charge and without any exclusivity. You agree that you either own the content or have permission to share it, and that it doesn't break any laws or harm others' rights. SeaVela can remove any content that is rude, untrue, confusing, or breaks these rules.

12. Disclaimers

The SeaVela Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. SeaVela does not warrant that:

  • The Platform will be uninterrupted, error-free, or free of viruses
  • Listings, descriptions, or prices provided by Operators are accurate or complete
  • Any particular vessel will be available at the time of your booking

SeaVela acts solely as a marketplace and is not a party to the rental agreement between the Renter and Operator. We are not responsible for the quality, safety, legality, or availability of any vessel listed on the Platform.

13. Limitation of Liability

To the fullest extent permitted by applicable law, SeaVela and its directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the Platform
  • Any booking made through the Platform
  • Actions or omissions of Operators or their crew
  • Loss of data, revenue, or profits
  • Personal injury or property damage during a charter

In no event shall SeaVela's total liability to you exceed the total amount paid by you for the specific booking giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless SeaVela and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Portugal and applicable European Union regulations. Any disputes arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties.

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of Portugal. For consumers in the EU, disputes may also be submitted through the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Third-Party Services and Links

The Platform may contain links to third-party websites or integrate third-party services (such as payment processors, mapping tools, or analytics providers). SeaVela does not control and is not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their respective terms and privacy policies.

17. Force Majeure

SeaVela shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather conditions, government restrictions, strikes, pandemics, or disruptions to internet infrastructure.

18. Modifications to the Platform and Terms

SeaVela reserves the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We may also update these Terms periodically. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. It is your responsibility to review these Terms regularly.

19. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining Terms, which shall continue in full force and effect.
